It probably shouldn’t be a surprise that a lawsuit is now threatening a big project in downtown San Diego.
As the San Diego Union is reporting, a lawsuit has been filed against an L-A based real estate investment company that could affect the future of the plan already approved by the City Council to convert the35 year old Horton Plaza shopping mall into a high tech mix of offices and restaurants.
Horton Plaza is clearly not what it once was when it first opened in 1985 as an innovative and architecturally unique outdoor mall that revitalized downtown San Diego at the time.
Most stores have left and so have most shoppers. But the one longtime retail giant at Horton Plaza, Macy’s is now suing the developer.The lawsuit points to an agreement when the mall first opened that Macy’s says requires the owner of Horton Plaza to maintain a first class shopping center.
The developers of the new project say they are hopeful of reaching a settlement, but if not, they say the suit could mean no project.
Sadly, major projects in San Diego have been threatened or stopped by lawsuits in the past.Take Petco Park, the expansion of the SD Convention Center and the now finally under construction Navy Broadway complex.
The Horton Plaza site is an extremely key part of downtown development and what happens there can affect the local economy.And city leaders certainly hope that things can be worked out so the work can continue.
