SAN DIEGO - A jury says a former San Diego public defender is a victim of discrimination.
The County of San Diego has been ordered to pay Zachary Davina $2.6 Million in a wrongful termination suit. Davina claims after nearly two years on the job he was forced out of the public defender's office because of his gender expression as a gay man and because of a complaint about a racist remark by a supervisor.
A review panel apparently took issue with his hair style, painting his nails and wearing an earing and said he was harming his clients by being flamboyant. The supervisor he complained about was on that review panel.
The jury found Davina had been discriminated against on the basis of his gender expression, but not on his sexual orientation.
