Lawsuit Over 2021 Pro-Trump Rally in Pacific Beach Dismissed

SAN DIEGO - A federal judge has dismissed a lawsuit over a 2021 pro-Trump rally in Pacific Beach.

The lawsuit filed on behalf of two anti-Trump protesters was tossed out because their attorney failed to summon the 10 San Diego Police officers named in the suit within the 90 days allowed by law, according to the San Diego Union-Tribune. The attorney apparently downplayed the failure as a simple 'oversight.'

Trump supporters clashed with anti-Trump protesters and alleged ANTIFA members during the January 9th rally, just days after the January 6th Capitol Riot. One alleged ANTIFA member present at the Pacific Beach rally was arrested and sentenced to prison for assault while several more alleged ANTIFA members were indicted on numerous charges.

The skirmish between the two groups lead San Diego Police to declare an unlawful assembly and disperse the crowd, but the order turned out to only apply to the anti-Trump crowd. The two women who filed the lawsuit claim this was discrimination.

Their attorney said he plans to appeal the dismissal but could also file the lawsuit in state court.
