One Bad Step, One Big Claim

A 35 million dollar claim has been filed against the City of San Diego, after an exposed parking meter base in Mission Hills, caused a 70 year old man to trip and fall.

That fall caused the man, who doesn't wish to be identified, to suffer a broken neck and back.

His attorney, William Berman, tells NBC 7 the city created a dangerous condition when it removed the parking meter last year, but left part of the base and bolts on the sidewalk exposed.

The man has been released from the hospital, but now requires 24/7 care at home. The city isn't commenting on the case, but Bermin says if there's no response to the claim, he'll file a civil lawsuit.
