Wrongful Death Suit Filed in connection with Downtown Bus Choking Death

SAN DIEGO - The parents of a man who was choked to death on a bus in Downtown San Diego have filed a wrongful death lawsuit.

The lawsuit filed by the parents of Anthony McGaff, 28, claims the MTS driver failed to protect their son and should have stopped the bus during the incident, according to a report by CBS 8. The lawsuit comes after the parents filed a tort claim with MTS, which the transit agency denied.

McGaff's parents also said that media reports of their son's killer as a 'Good Samaritan' are inaccurate. They say what really happened in April of 2022 is their son was being harassed by a female passenger on the bus who was taking video of him after he had asked her to stop. When he tried to take her second recording device away from her, that's when 55-year-old Edward Hilbert intervened and placed McGaff in a chokehold for several minutes.

McGaff's parents say they've seen the surveillance video from the bus in which other passengers were screaming, yet the bus driver just kept driving.

Hilbert pleaded not guilty to involuntary manslaughter. He's expected to make another appearance in court on Thursday, December 15th.
